OVERVIEW

Welcome to Fusion Attire! The terms “we”, “us” and “our” refer to Fusion Attire Pty Ltd, a company incorporated in Botswana in 2025. Fusion Attire operates this online store and website, including all related content, features, tools, products, and services (collectively, the “Services”) to provide you with a curated shopping experience featuring authentic African fashion brands.

Fusion Attire is powered by Shopify, which enables us to provide the Services to you. These Terms of Service (the “Terms”) govern your use of the Services. By visiting, interacting with, or purchasing through our website, you agree to be bound by these Terms as well as our [Privacy Policy]. If you do not agree, you may not use or access the Services.

SECTION 1 – ACCESS AND ACCOUNT

You must be at least the age of majority in your country of residence to use our Services.

You agree to provide accurate, current, and complete information when creating an account or making a purchase.

You are responsible for safeguarding your account credentials. Any activity under your account will be deemed your responsibility.

SECTION 2 – OUR PRODUCTS

Fusion Attire partners with independent African designers and brands. Product descriptions are provided by Fusion Attire in collaboration with brand partners.

Colors, textures, and finishes may vary slightly due to photography, screen settings, or handmade processes.

We reserve the right to modify, limit, or discontinue products at any time without notice.

SECTION 3 – ORDERS

By placing an order, you make an offer to purchase. Orders are confirmed once payment is processed and Fusion Attire issues an acceptance notice.

Fusion Attire may refuse, cancel, or adjust orders at its discretion (e.g., stock unavailability, errors, or suspected misuse).

Orders are fulfilled by brands or Fusion Attire’s logistics partners. Some multi-brand orders may ship separately.

Returns and refunds are handled in accordance with our [Refund & Returns Policy].

SECTION 4 – PRICING & BILLING

Prices are listed in Botswana Pula (BWP) by default and may be displayed in your local currency depending on your location.

Prices exclude shipping fees, customs, and import duties unless stated otherwise.

You agree to provide accurate billing and payment details and authorize Fusion Attire (or its payment processors) to charge your chosen method of payment.

Payments are securely processed via DPO Payment Gateway and other approved processors.

SECTION 5 – SHIPPING & DELIVERY

Domestic (Botswana):

Courier: Sprint Couriers

Delivery: 2–6 business days (after order processing)

Flat rate: P40

International:

Courier: FedEx International

Delivery: 5–14 business days (excluding customs delays)

Fees: Calculated at checkout

General:

Orders are processed within 2–3 business days.

Customs duties, VAT, or import taxes are the responsibility of the buyer.

Once a package is handed over to the courier, liability transfers to the buyer. Fusion Attire is not responsible for courier delays, customs holds, or incorrect shipping details provided at checkout.

SECTION 6 – RETURNS & REFUNDS

We want you to feel confident in your Fusion Attire purchase. Eligible items can be returned within 7 days of receipt, subject to the following conditions:

Items must be unused, unwashed, in original packaging, with all tags attached.

Returns are not accepted for intimate apparel, pierced jewelry, gift cards, final-sale, or made-to-order items.

Return shipping is the responsibility of the customer (domestic & international).

Refunds (excluding shipping fees) are processed to the original payment method within 7–10 business days once the item is inspected.

SECTION 7 – INTELLECTUAL PROPERTY

All content on Fusion Attire’s Services (including logos, product images, graphics, and brand identity) is owned by Fusion Attire or its brand partners and protected by copyright and trademark laws. You may not copy, modify, distribute, or use our content without permission.

SECTION 8 – RELATIONSHIP WITH SHOPIFY

Fusion Attire is powered by Shopify. However, your purchases are made directly with Fusion Attire. Shopify is not a party to your transactions and bears no responsibility for your orders, returns, or refunds.

SECTION 9 – PRIVACY & DATA

Your personal information is collected, stored, and processed in accordance with our [Privacy Policy]. Fusion Attire may share necessary data with Shopify, payment processors, and logistics partners to fulfill your order.

SECTION 10 – PROHIBITED USES

You agree not to use the Services for unlawful purposes, including fraud, harassment, IP infringement, spam, or attempts to disrupt the website’s functionality. Fusion Attire reserves the right to suspend or terminate accounts for misuse.

SECTION 11 – DISCLAIMER & LIMITATION OF LIABILITY

The Services are provided “as is” and “as available.”

Fusion Attire does not guarantee uninterrupted or error-free operation of the Services.

To the maximum extent permitted by law, Fusion Attire is not liable for indirect, incidental, or consequential damages, including shipping delays, customs issues, or product expectations not met.

SECTION 12 – GOVERNING LAW

These Terms shall be governed by the laws of the Republic of Botswana. Any disputes will be subject to the exclusive jurisdiction of the courts of Botswana.
